1. Acceptance of these terms
These Terms & Conditions (“Terms”) form a binding agreement between you and PHARMDAWG AI LLC (“hostdawg,” “we,” “us,” or “our”) governing your use of the hostdawg website and service (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
hostdawg is software that helps short-term-rental hosts manage a shared booking calendar, smart-lock door codes, and operational notifications across booking channels. Features may change over time.
3. Eligibility and your account
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.
4. Subscription and billing
Paid plans are billed on a recurring basis through our payment processor (Stripe). Subscriptions renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period; fees already paid are non-refundable except where required by law.
5. Your responsibilities and acceptable use
You are responsible for how you use the Service and the information you enter. You agree that:
- You will only add a cleaner’s or guest’s phone number or email when you have a direct relationship with that person and their permission to contact them through hostdawg about bookings and turnovers;
- You will comply with all applicable laws governing communications you initiate through the Service, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and carrier and CTIA messaging guidelines;
- You will not use the Service to send marketing, promotional, or unsolicited messages, or any unlawful, harassing, or deceptive content;
- You will not misuse, reverse-engineer, or attempt to disrupt the Service.
6. Messaging and SMS program
The Service sends transactional text and email messages on your behalf to recipients you designate — specifically, cleaner turnover dispatch notifications and guest check-in information. We do not send marketing or promotional messages.
- Consent. SMS consent is optional and never required to use the Service. A phone number is only texted after the host confirms (via an explicit, unchecked opt-in checkbox) that the recipient has given permission.
- Opt-out. Recipients can reply STOP at any time to stop all texts, and HELP for help. Message and data rates may apply.
- No third-party sharing. Mobile opt-in data, phone numbers, and SMS consent collected through the Service are never shared with, sold to, or provided to any third party or affiliate for marketing or promotional purposes.
You represent that you have obtained any consent required to message the recipients you add, and you are responsible for the content and lawfulness of messages sent on your behalf. See our Privacy Policy and Text message program page for full details.
7. Infrastructure providers
The Service uses infrastructure providers that act as data processors on our behalf — including Twilio (SMS delivery), Stripe (payments), and smart-lock integration providers. These providers operate under contract and process data only to perform services for us; they do not receive your data for their own marketing use. The Service also integrates with booking channels (e.g., Airbnb, Vrbo) to sync calendar and reservation data. Your use of any third-party service is subject to that service’s own terms, and we are not responsible for them.
8. Intellectual property
The Service, including its software, design, and content, is owned by PHARMDAWG AI LLC and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. You retain ownership of the data you submit.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that message delivery is guaranteed.
10. Limitation of liability
To the fullest extent permitted by law, PHARMDAWG AI LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
11. Indemnification
You agree to indemnify and hold harmless PHARMDAWG AI LLC from claims, damages, and expenses arising out of your use of the Service, the contacts and content you add, your messages, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date above. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the United States and the state in which PHARMDAWG AI LLC is organized, without regard to conflict-of-laws principles.
